Patrick’s Samburu Eco Tours – Booking Terms & Conditions

Booking Your Holiday

  • Your holiday contract is made with Patrick’s Samburu Eco Tours (the “Company”), registered in Kenya, and all bookings are subject to these terms and conditions.
  • All communications by the Company regarding your holiday will be sent to the address provided on the booking form.
  • Bookings must be made by an authorized representative using the Company booking form, along with a deposit of 50% of the total booking cost.
  • Receipt of the deposit and booking form does not guarantee confirmation. No booking is confirmed until the Company issues a written notice. The Company reserves the right to refuse any booking without explanation and will return any deposit received.
  • Full payment must be made at least 30 days before departure. Failure to pay by the due date may result in cancellation, with the deposit retained. The signatory of the booking form guarantees full payment.
  • Bookings made within 30 days of departure require full payment at the time of booking.
  • Special requests, such as dietary requirements, should be noted on the booking form.
  • The Company will provide services as set out and confirmed in writing.

Price Policy

  • The Company is not obliged to provide a breakdown of holiday costs.
  • The Company may notify you of any price increase before accepting your booking.
  • After issuing a Confirmation Invoice, the holiday price may be subject to surcharges only in limited circumstances, such as:
    • Transportation cost changes (including fuel),
    • Increased airfares or airport taxes,
    • Changes in exchange rates, or
    • Government or regulatory tax increases.
  • The Company will absorb 2% of the holiday price before applying any surcharge. Only amounts exceeding this 2% will be charged.
  • If a surcharge exceeds 10% of the original holiday price, you may cancel within 14 days of the revised invoice for a full refund.
  • Alternatively, paying in full at the time of booking will fix your holiday price.

Cancellation and Changes by the Company

  • The Company reserves the right to make changes to your holiday at any time and will notify you as soon as possible.
  • Major changes include cancellation, airline changes, delays over 12 hours, or accommodation downgrades.
  • Minor changes include small adjustments to flight times, aircraft type, or equivalent accommodation changes.
  • Compensation for major changes may apply unless caused by circumstances beyond the Company’s control (force majeure, war, strikes, natural disasters, etc.).
  • The Company may cancel your holiday at any time before departure; in such cases, a full refund will be provided. No additional compensation will be paid.

Cancellation and Changes by You

  • You may cancel your holiday in writing at any time. Cancellation charges are:
    • 30+ days: 50% of deposit
    • 15–30 days: 100% of deposit
    • 8–15 days: 80% of total tour cost
    • 1–7 days: 100% of total tour cost
  • After confirming the itinerary, you may make one set of amendments free of administrative charges. Further modifications incur a KSh 3,000 fee.

Our Responsibilities

  • The Company does not own or manage transport, accommodation, or facilities used. While providers are carefully selected, the Company does not guarantee inspections or quality beyond exercising due care.
  • The Company is not responsible for injury, illness, or death arising from third-party actions or events beyond its control.
  • The Company is not liable for unused tickets unless refunds are obtained from the provider.

Your Responsibilities

  • You must arrange your own travel insurance, covering all booked activities. Proof of insurance must accompany the booking form.
  • Each traveler must have a valid passport, visas, and all required documentation. The Company is not responsible for delays or expenses due to incomplete documentation.
  • You are responsible for timely flight check-ins and participation in all pre-booked components. No refunds or credits are provided for missed services or lost/damaged travel documents.
  • You must behave responsibly and not disrupt other travelers or harm the Company’s reputation. Breaches may result in termination of the holiday, with the Company entitled to compensation for damages.
  • Any pre-existing medical conditions must be disclosed on the booking form.
  • All personal effects are at your own risk; the Company is not liable for loss, damage, or delay unless caused by Company negligence.

Smoking

  • Smoking is prohibited in any Company-operated vehicle. Frequent stops will be provided. Accommodation is non-smoking unless otherwise requested and confirmed by the hotel.

Waiver

  • Some tours involve inherent risks. Clients may be required to sign a Waiver of Responsibility, acknowledging the need to exercise judgment and care for their safety and that of fellow travelers.

Disclaimer

  • The Company has made reasonable efforts to ensure website accuracy but is not responsible for errors or omissions.

Complaints

  • Report problems immediately to the airline, hotel, local agent, or other supplier. If unresolved, contact the Company office promptly.
  • If the issue remains unresolved, submit a written complaint within 28 days of returning home, including your booking reference. Failure to do so may limit or invalidate any claim.
  • Any disputes will be governed by Kenyan law, with both parties submitting to the jurisdiction of Kenyan courts.

Data Protection

  • The Company may request personal information (e.g., dietary, medical, or religious requirements). Information will be kept confidential and shared only with suppliers where necessary to fulfill the holiday contract.
